1. It has been observed and reported that many students, learners, and employees of the Department of Education (DepEd) ride on motorcycles or habalhabal without wearing the standard protective helmets.

2. In this connection, the DepEd reiterates the provisions contained in DepEd Memorandum (DM) No. 190, s. 2010 entitled Dissemination of Republic Act 10054 also known as the Motorcycle Helmet Act of 2009. This is to secure and safeguard the driver and passengers of motorcycles from ruinous and extremely injurious effects of fatal or life threatening accidents and crashes.

3. All DepEd personnel and students are strictly required to comply with the use of standard protective motorcycle helmet as provided under RA 10054. Specifically, Section 3 of said law states:

Section 3. Mandatory Use of Motorcycle Helmets. – All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.

Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that comply with the specifications issued by the Department of Trade and Industry (DTI).

4. Regional directors and school division superintendents are directed to issue their respective guidelines to ensure that the policies stipulated in the abovementioned law are being strictly followed by all students and personnel who are drivers and motorcycle riders.

5. Immediate dissemination of this Memorandum is desired.
