1. This Office hereby provides the field with a copy of MEMORANDUM ORDER NO. 202 – 5-2019 issued by the City Government of Dasmariñas on March 15, 2019 to inform the field of the prescribed guidelines in the issuance of permits for public assemblies! rallies.
2. In view of the foregoing, attention of all concerned is invited to paragraphs a, b, & c that specifically prohibits the following acts to wit:
(a) The holding of any public assembly without having first secured a written permit where a permit is required from the office concerned;
(b) The use of such permit for such purposes in anyplace other than those set out in said permit;
(c) The following acts committed within 100 meters from the area of activity of the public assembly or on the occasion hereof
i. carrying a deadly or offensive weapon or device such as firearms, pillbox, bomb, and the like;
ii. carrying a bladed weapon and the like;
iii. malicious burning of any object in the street or thoroughfares;
iv. carrying of firearms by members of the law enforcement unit;
v. interfering with or intentionally disturbing the holding of public assembly by the use of a motor vehicle, its horn and loud sound systems.
Furthermore, all concerned are advised to be guided by the following procedures for applying a permit for use of multi- purpose covered court in the City of Dasmariñas for holding public assembly/rally:
(a) A written permit shall be requiredfor any organization or person intending to use any multi- purpose covered court in the City of Dasmarinas for holding public assembly or rally.
(b) All applications for a permit shall comply with the following:
i. The application shall be in writing, addressed to the City Mayor and shall include the names of the leaders or organizers, the purpose thereof and the EXACT date, time and duration of the same.
ii. The application shall be filed with the office of the City Mayor, at least five (5) working days before the scheduled use. Any application filed in less than (5) working days before the scheduled use shall be deemed automatically denied.
iii. It shall be the duty of the mayor or any official acting in his behalf to issue or grant a permit unless there is a clear and convincing evidence that the use of the multi- purpose covered court will create a clear and present danger to public order, public safety, public convenience, public morals or public health and/or there has already been a previous request for the use of the intended venue and the same has already been granted.
iv. The mayor or any official acting in his behalf shall act on the application within three (3) working days from the dale the application was flied. If no action was taken during the said period, the application shall be deemed granted
v. If the mayor is of the view that there is immine3nt and grave danger of a substantive evil warranting the denial or modification of the permit, he shall immediately inform the applicant.
vi. If no application was filed and/or an application has been denied, it shall be unlawful for the applicant to use the multi- purpose covered court. In
this case, the police authorities shall be enjoined to prevent the said gathering without prejudice to the filing of a criminal action in court.
4. Other significant details relative to the issuance of permits for public assemblies /rallies in multi – purpose covered courts in the city of Dasmariñas are provided in Memorandum Order No. 202- S- 2019.
